Terms of Service
These Terms of Service govern access to and use of Brandario. They are drafted for an Italy-based SaaS operation and should be completed with the operator legal details before production launch.
1. Scope of the service
Brandario is a software platform for influencer marketing. It helps creators and, in later product phases, agencies connect social accounts, review performance data, manage public media kit information, and support discovery workflows.
These Terms apply to all visitors, registered users, and any person using the service through connected third-party platforms.
2. Acceptance and eligibility
By creating an account, connecting a social profile, or otherwise using the service, you confirm that you have legal capacity to accept these Terms and that the information you provide is accurate and up to date.
If you act on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.
3. Account registration and security
You are responsible for maintaining the confidentiality of your login methods and for activities carried out through your account.
You must promptly notify Brandario if you become aware of unauthorized access, token compromise, or misuse of connected social accounts.
4. Connected social accounts and permissions
When you connect TikTok, Instagram, or another supported platform, you authorize Brandario to receive the data and permissions explicitly granted through that platform OAuth flow.
You remain responsible for ensuring that you are entitled to connect the account and to authorize the import of related profile, content, and analytics data.
- Brandario only uses the permissions necessary for the features made available in the product.
- You may disconnect supported accounts, but some historical records may be retained where required for security, legal compliance, or audit purposes.
- Third-party platform terms and policies continue to apply to your use of those platforms.
5. Creator content, public media kits, and discovery
You retain responsibility for the content, profile information, and business claims displayed through your Brandario account or public media kit.
If you enable public visibility or discovery-related options, you instruct Brandario to publish or index the selected information within the scope of the corresponding feature.
- Do not publish unlawful, misleading, defamatory, infringing, or deceptive material.
- Do not present estimated or third-party metrics as verified metrics when they are not supported by the platform data imported through Brandario.
- You may request correction or removal of inaccurate information made public through the service.
6. Acceptable use
You agree not to misuse the platform, interfere with the service, or attempt to gain unauthorized access to data, infrastructure, or other user accounts.
- No scraping, reverse engineering, or automated extraction beyond what is expressly authorized.
- No use of the platform to violate advertising, consumer protection, privacy, intellectual property, or competition laws.
- No upload of malware, harmful code, or abusive traffic.
7. Intellectual property
Brandario and its software, branding, interface elements, and related materials are protected by applicable intellectual property laws. Except where expressly permitted, no license is granted other than the limited right to use the service under these Terms.
You grant Brandario the limited rights necessary to host, process, reproduce, and display the information and content you submit solely for operating, securing, and improving the service.
8. Availability, suspension, and changes
Brandario may update, suspend, or modify features when reasonably required for security, legal compliance, third-party platform changes, maintenance, or product evolution.
Access may be suspended or terminated if there is a breach of these Terms, a security risk, unlawful use, or a third-party platform action that prevents continued operation.
9. Warranties and limitation of liability
To the maximum extent permitted by applicable law, the service is provided on an as available basis. Brandario does not guarantee uninterrupted availability, error-free operation, or continued access to third-party platform APIs.
Nothing in these Terms excludes liability for fraud, gross negligence, willful misconduct, death, personal injury, or any liability that cannot be excluded under applicable law.
Where permitted, Brandario is not liable for indirect, consequential, or loss-of-profit damages, or for losses caused by third-party platforms, user conduct, or data supplied by users.
10. Consumer rights and mandatory law
If mandatory consumer protection rules apply to you, including under Italian Legislative Decree no. 206/2005 as amended, those mandatory rights remain unaffected.
For digital services that begin immediately after activation, you acknowledge that some statutory withdrawal rights may be limited once performance has started, where allowed by law and after the required consent statements are collected.
11. Governing law and disputes
These Terms are governed by Italian law, including Legislative Decree no. 70/2003 where applicable, without prejudice to any mandatory consumer protections that may apply under the law of the user habitual residence.
Unless a mandatory forum applies, disputes shall be submitted to the court with territorial jurisdiction over the service operator registered office in Italy.
